This paper proposes that billing gamesmanship occurs when physicians free-ride on the billing practices of other physicians. Gamesmanship is non-universalizable and does not exercise a competitive advantage; consequently, it distorts prices and allocates resources inefficiently. This explains why gamesmanship is wrong. This explanation differs from the recent proposal of Heath (2020. Ethical issues in physician billing under fee-for-service plans. J. Med. Philos. 45(1):86–104) that gamesmanship is wrong because of specific features of health care and of health insurance. These features are (...) aggravating factors but do not explain gamesmanship’s primary wrong-making feature, which is to cause diffuse harm not traceable to any particular patient or insurer. This conclusion has important consequences for how medical schools and professional organizations encourage integrity in billing. To avoid free-riding, physicians should ask themselves, “could all physicians bill this way?” and if not, “does the patient benefit from the distinctive service I am providing under this code?” If both answers are “no,” physicians should refrain from the billing practice in question. A public accounting firm’s ethical environment has an important role in encouraging ethical behavior, but prior research has shown that firm leaders perceive the ethical environment of their firms to be stronger than do non-leaders : 637–654, 2010). This study draws on several research streams in management to investigate the reasons behind this discrepancy. Our online questionnaire was completed by 139 accounting professionals. We find that when non-leader accounting professionals believe that they have a meaningful role in shaping and maintaining (...) the ethical environment and/or have strong organizational fit with the accounting firm, they are more likely to perceive the ethical environment as strong and to perceive it similarly to firm leaders. That is, differences in leaders’ and non-leaders’ perceptions of the ethical environment are mediated by non-leaders’ perceptions of their role in participating in shaping and maintaining the ethical environment of their firms. Further, we find that among firm leaders, a stronger public interest orientation and a higher frequency of receiving mentoring are both associated with stronger perceptions of the ethical environment. Overall, our study is one of the first to directly test potential explanations for why firm leaders and non-leaders can have disparate views of a firm’s ethical environment. In addition, these findings provide practical feedback to practitioners on actions they can take to improve perceptions of their firms’ ethical environment. (shrink)

The predominant conception of the status of race is that race is a social construction. But what does it mean to say that a group, racially defined, is a social construct? How we understand the process of constitution and related identities is important beyond the conceptual reality or non-reality that defines the group. To this end, this dissertation explores two models of group constitution employed by Jean-Paul Sartre, the first from Anti-Semite and Jew, which bases group constitution and identity on (...) the gaze of the dominant Other, and the second from his later work, Critique of Dialectic Reason, Vol.1, which places the group as a prominent facilitator of history that produces itself in the domain of the Other. Both models show that the existence of group and group identity are constructed and as a result both reject claims of essentialism that may be ascribed to the group. However, I argue that the more nuanced conception of the social construction of the group, found in the Critique, envisages a more complex and dynamic account of group formation and identification, an account that acknowledges the need for group identities particularly among those who are historically oppressed as members of a group. ;My dissertation attempts to reconcile two fundamental and distinct approaches to race---ontology and experience---through what I hope the reader will appreciate as a series of dialogues between Sartre and various interlocuters. These interlocuters include contemporary authors such as Ian Hacking, K. Anthony Appiah, and Naomi Zack whose works refer to some aspect of Sartrean thought. Additionally, I explore textual dialogues between Sartre and both Maurice Merleau-Ponty and Frantz Fanon, existentialists authors themselves, whose works provide insights into the possibilities and problems that Sartre faced in his attempts to attend to colonialism, racism, race and class consciousness, individual and group freedom. Thus, a secondary goal of this dissertation is to show Sartre's continued relevance to our contemporary discourse of race in particular and contemporary philosophy in general. (shrink)

It seems that more often than not, refugees and asylum seekers are associated with the notion of ‘limbo’. This terminology is used to illustrate situations in which people are unable to access systems that would alleviate their ‘standstill’ lives. In other words, when it is said that people are in limbo, it is understood they have a sense of hopelessness. Specifically, in the media, at least three examples of ‘limbo’ are often used: limbo as a physical space, limbo as a (...) type of legal conflict or legal irreconcilability and metaphysical limbo or the type of limbo that exists in one’s mind. Unfortunately, the refugee experience is so commonly associated with the idea of limbo that it appears to be the central space that refugees ‘belong’—presumably, due to the inaccessible or unpreventable nature of their predicament, they are unable to escape their life in limbo. However, it is important to understand that limbo does not simply ‘exist’. It is something that is created. In the case of Australia, refugee limbos appear as certain types due to the restrictive nature of the Government’s laws and policies. This article explores the usage of the term ‘limbo’ in the media in order to draw attention to its overwhelming presence and map specific types of discourse and ideologies. Further, it is shown that limbo should not be considered something which is out of our control or something inherent in the refugee experience but instead, is a tool used by governments to restrict refugee access to the border and systems of protection. The problem of evil has traditionally been formulated as a claim about the incompatibility of the statements ‘God exists’ and ‘There occur instances of suffering’. Hume, for example, in his Dialogues Concerning Natural Religion , part x, claims that the statements ‘God exists’ and ‘There occur instances of suffering’ are incompatible. In his esssy ‘Hume on Evil’, Nelson Pike argues that it has not been shown that the statements ‘God exists’ and ‘There occur instances of suffering’ are incompatible because it (...) has not been shown that God could not have a morally sufficient reason for permitting suffering he could prevent. 1 Moreover, according to Pike, the theist who is convinced that God must have a morally sufficient reason for permitting suffering he can prevent will claim that the statements ‘God exists’ and ‘There occur instances of suffering’ are not incompatible. He will claim this even though he cannot specify the morally sufficient reason why God permits suffering he can prevent. The theist will thus maintain that God exists even given the occurrence of suffering in the world. 2 Robert Richman, in his essay ‘The Argument from Evil’, argues that Pike is too generous to the theist. According to Richman, only if the theist can specify the morally sufficient reason why God permits suffering he can prevent will the theist be rationally justified in maintaining that God exists in the face of suffering in the world. Richman supports his position by reformulating the argument from evil in terms of what he calls ‘the logic of our moral judgmentsr’. 3 Richman thinks that his formulation of the argument from evil is successful against the theist who cannot specify the morally sufficient reason why God permits evil he can prevent. In this paper, I shall argue that Richman's argument is not successful against the typical theist, i.e. the person who accepts the existence of God on the basis of faith or a priori arguments. 4. The objective in this paper is to demonstrate the indispensability of Peirce’s double consciousness to foster abductive reasoning, so that internal/external dialogue inform the worthiness of hunches. These forms of dialogue establish a mental give-and-take forum in which novel meanings/effects are particularly highlighted and noticed. Such attentional shifts are compelled by surprising states of affairs within the beholder’s internal, interpretive competencies, or from external factors (pictures, gestural or linguistic performatives). The dialogic nature of these signs pre-forms operations not possible non-dialogically; (...) they command, interrogate, or suggest alterations to established conduct/beliefs in contexts in which propositional/argumentative conflicts are obviated. This inquiry proposes experimental methodologies to measure when double consciousness (via private/inner speech) mediates hypothesis-making. Vygotsky’s conflict of motive at four distinct developmental stages constitutes the foundation for the proposed experiments. Designs draw upon Vygotsky’s ‘double stimulation’ paradigms that force decision-making processes when conflicts of motive surface. Paradigms include forced imitation of one model while ignoring another (imitating bear, not dragon), and altering a visual array to depict logical sequencing accurately (the “Cycles Test”; “The Odd One Out”). These conflicts require children to change their conduct/beliefs to accommodate to atypical states of affairs. (shrink)

A number of theoretical positions in psychology—including variants of case‐based reasoning, instance‐based analogy, and connectionist models—maintain that abstract rules are not involved in human reasoning, or at best play a minor role. Other views hold that the use of abstract rules is a core aspect of human reasoning. We propose eight criteria for determining whether or not people use abstract rules in reasoning, and examine evidence relevant to each criterion for several rule systems. We argue that there is substantial evidence (...) that several different inferential rules, including modus ponens, contractual rules, causal rules, and the law of large numbers, are used in solving everyday problems. We discuss the implications for various theoretical positions and consider hybrid mechanisms that combine aspects of instance and rule models. (shrink)

The concept of corporate social responsibility (CSR) is being supplanted by a new term—corporate citizenship (CC). For many reasons, it’s not a bad idea to replace the CSR term. But the core content of CSR is also gradually being replaced in a significant portion of the literature by a narrower, voluntaristic concept of corporate community service. This is not a viable replacement for the broad ethics-based and problem-solving norms of social reciprocity that are represented by CSR. A more legitimate successor-term (...) is needed so that corporate community relations and philanthropy take their rightful place among the larger set of rights, duties, stakeholder relationships, and opportunities accruing to business organizations.Therefore, we develop a working theory of business citizenship (BC), a more palatable term, and a concept designed to capture the core moral and social content of CSR. In this article we extract and synthesize several key ideas about individual citizenship that have evolved over several thousand years. We then transpose these ideas from the level of individual members of a polity to the level of organizations within society. In a companion article, we extend the business citizenship concept from its single-polity boundaries to the institutional and global levels of analysis. This approach allows a view of business citizenship that accommodates strong moral guidance, structural and institutional realities, and the flexibility necessary to respond to the structures and dynamics of particular company-stakeholder relationships. In practice we regard actions as right or wrong, and character as good or bad, partly according to what happens as a result of the agent's decision. Yet we also think that people should not be held responsible for matters beyond their control. ;This split underpins Kant's assertion (...) that only the good will is securely good, that its goodness is impervious to outcome ill-luck. Some commentators, such as Martha Nussbaum and to some extent Bernard Williams, think that this simply writes off the paradox. Williams asserts that the paradox is insoluble, and that its inescapability threatens the notion of agent responsibility. In contrast Thomas Nagel argues that agents' most cherished projects may be indeed be subject to luck, but that does not mean that their deepest motivations are moral. This, I suggest, is one of several means whereby we might limit the effect of the paradox without denying that the tension exists. But I also argue that it is wrong to accuse Kant of ignoring the paradox. ;Ethical consequentialists, on the other hand, appear to have no problem with moral luck, because the paradox depends on a dichotomy between the outside world and the locus of moral worth in the individual agent. But this turns out not to be true. The problem of moral luck is not some strange Kantian fixation, but a general dilemma: a variant on what Nagel terms "the problem of excess objectivity" which cuts across all of ethics and metaphysics. ;Retaining a broadly Kantian notion of agent-responsibility, but limiting what agents are responsible for, requires us to delineate the realm of ethics more narrowly than has been done by those who believe that the rational and/or prudential are coterminous with the ethical. This strategy for minimising the paradox's impact is explored in two areas from medical ethics, the allocation of scarce medical resources and informed consent, and two from public policy, secrecy and nuclear deterrence. Throughout, the analysis seeks to test Nagel's maxim that the best we can hope for is to act in such a manner that we would not have to revise our opinion of how we should have acted once the consequences of our actions become apparent. What constitutes better schooling for today's youth? In 1984 educational theorist Theodore R. Sizer formulated nine Common Principles to answer this question and launched The Coalition of Essential Schools, an organization of schools attempting to change their own structure, curriculum, pedagogy, and power relations according to Sizer's Principles. This important book, the first comprehensive look at Coalition schools, charts the course of reform at eight charter member schools. The Coalition now counts over 900 private, parochial, public, urban, suburban, and rural (...) secondary schools among its affiliates nationwide. Donna E. Muncey and Patrick J. McQuillan, experts in anthropology as well as education, conducted a five-year ethnographic study to understand what happened in Coalition schools. The authors looked at curricular and pedagogical developments; how changes affected individual students, teachers, administrators, and other school personnel; and how American cultural beliefs influenced efforts to change. The schools' reform experiences differed: some efforts were sustained when others stalled, change divided some faculties while others found a sense of shared purpose, and the principals of some schools facilitated change while others clearly inhibited it. This compelling book, written for all who are concerned with education in America, offers a wealth of insights into the complexities of change efforts in individual schools and in classrooms. “Losing Thomas & Ella” presents a research comic about one father’s perinatal loss of twins. The comic recounts Paul’s experience of the hospital and the babies’ deaths, and it details the complex grieving process afterward, including themes of anger, distance, relationship stress, self-blame, religious challenges, and resignation. A methodological appendix explains the process of constructing the comic and provides a rationale for the use of comics-based research for illness, death, and grief among practitioners, policy makers, and the bereaved.

FemaleMan_Meets_OncoMouse explores the roles of stories, figures, dreams, theories, facts, delusions, advertising, institutions, economic arrangements, publishing practices, scientific advances, and politics in twentieth- century technoscience. The book's title is an e-mail address. With it, Haraway locates herself and her readers in a sprawling net of associations more far-flung than the Internet. The address is not a cozy home. There is no innocent place to stand in the world where the book's author figure, FemaleMan, encounters DuPont's controversial laboratory rodent, OncoMouse. (...) Haraway sees the world of contemporary technoscience as a drama. Information sciences and life sciences are at the center of the dramatic action. Scenes are set in landscapes where maps of human genetic differences are stored in databases, racialized bodies are reconfigured by morphing for photographs in popular magazines, and transgenic mice important to breast cancer research are patented intellectual property. The actors are many, and not all are human. Beginning with the Modest Witness, the key figure in the Science Revolution, Haraway shows us the trouble lurking in race and gender- marked practices for attesting to matters of fact. In later scenes, Haraway explores the kinship relations among the many cyborg creatures produced in the late twentieth-century--in nuclear research, genetic engineering, reproductive technologies, computer-mediated representational practices, and mutations in biological approaches to "race.". This study examines the impact of a social desirability response bias as a personality characteristic (self-deception and impression management) and as an item characteristic (perceived desirability of the behavior) on self-reported ethical conduct. Findings from a sample of college students revealed that self-reported ethical conduct is associated with both personality and item characteristics, with perceived desirability of behavior having the greatest influence on self-reported conduct.
